Agreement
These Terms of Use are a binding agreement between you and Koltez. By downloading, accessing or using the app you accept them. If you do not accept them, do not use the app. If you are under the age of majority where you live, you may only use Koltez with the consent of a parent or guardian.
Licence
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use Koltez on devices you own or control, for your own non-commercial learning. This licence is granted subject to the Usage Rules of the Apple Media Services Terms and Conditions. You may not copy, sell, sublicense, rent, or redistribute the app, and you may not reverse-engineer, decompile or attempt to extract its source code except to the extent the law expressly permits.
Your account
You must give accurate information when you register and keep your credentials secure. You are responsible for activity that happens under your account. Tell us promptly at support@koltez.com if you believe it has been used without your permission. You may delete your account at any time from Settings, which is permanent. We may suspend or terminate an account that breaches these terms, or where we are required to by law.
Educational content is not professional advice
Koltez is for general learning and curiosity. Nothing in it is medical, legal, financial, psychological or other professional advice, and it must not be relied on as such. Always consult an appropriately qualified professional before making a decision that matters. Content is condensed by design and may simplify contested or evolving subjects.
AI-generated content
Some features, including rabbit-hole explorations and generated study plans, produce content using artificial intelligence. AI output can be inaccurate, incomplete, out of date or misleading, and it may occasionally produce content you find objectionable despite the safeguards we apply. Do not rely on it as fact without checking. If you see something wrong or inappropriate, use the report option on the card or question. We review reports and act on objectionable content, including removing it, within 24 hours of a report where it is warranted.
Acceptable use
Use Koltez lawfully and respectfully. You must not: attempt to disrupt, overload, probe or gain unauthorised access to the service; reverse-engineer or tamper with the app or its data; use automated means to scrape or extract content at scale; manipulate scores, streaks or leaderboards, including by tampering with data stored on your device; use the app to harass, harm or infringe the rights of others; or use it in a way that breaks any applicable law. Attempting to bypass the fairness rules in features such as Recall is a breach of these terms.
Our content
The app, its design, its software, and the learning content in it are owned by Koltez or its licensors and are protected by intellectual property law. You may not reproduce or distribute the content outside the app except as the law permits. Third-party names mentioned in educational content belong to their respective owners and are used for identification and commentary only.
Content you submit
If you send us a report, feedback or a suggestion, you grant us a worldwide, royalty-free licence to use it to operate and improve Koltez. Do not send us anything confidential or anything you do not have the right to send.
Availability and changes
We may add, change, suspend or withdraw features at any time, and we may need to take the service down for maintenance. We do not guarantee that the app will be uninterrupted or error-free.
Disclaimer of warranties
To the fullest extent permitted by law, Koltez is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Nothing in these terms excludes any right you have as a consumer that cannot be excluded by law.
Limitation of liability
To the fullest extent permitted by law, Koltez is not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, nor for any loss of data, profits, revenue, or goodwill, arising from your use of, or inability to use, the app. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Indemnity
You agree to indemnify Koltez against claims, losses and reasonable costs arising from your breach of these terms or your misuse of the app, to the extent permitted by law.
Apple
You acknowledge that these terms are between you and Koltez, not Apple, and that Apple is not responsible for the app or its content. Apple has no obligation to provide any maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any; to the maximum extent permitted by law Apple has no other warranty obligation in respect of the app. Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability, regulatory non-compliance, or consumer protection claims, or any claim that the app infringes intellectual property rights. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You represent that you are not located in a country subject to a United States Government embargo or designated as terrorist-supporting, and that you are not on any United States Government restricted-parties list.
Changes to these terms
We may update these terms as the app evolves. If a change is significant, we will notify you in the app. Continuing to use Koltez after an update means you accept the revised terms.
Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, unless the mandatory law of the country you live in gives you the right to bring proceedings where you live.
